Abstract

The international agreements reached by the EC are now viewed as disputable by the Court of Justice, which, since 1994, has not hesitated to make ex post facto alterations to these to ensure their compatibility with the Treaty of Rome. The Court has ample justification for its actions, resting mainly on the requirement to protect the autonomy and normative framework of the community’s judicial underpinnings. Nevertheless, we cannot rule out the possibility of objections being raised by the EC’s partner States, whose agreements are altered by the Court.
